  1. What does "negligence" mean?

    Negligence means a failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances, to protect others from bodily injury, death or property damage.

  2. Can a child be held liable for negligence?

    A child under the age of seven at the time of an occurrence is incapable of negligence. A child (seven years of age or older at the time of an occurrence) is under a duty to use that degree of care which children of similar age, experience and intelligence would ordinarily use under the same or similar circumstances to protect others from bodily injury, death or property damage.

  3. What "damages" are recoverable in a personal injury case?

    If a person is injured by the negligence of another, he or she is entitled to recover monetary compensation, called "damages," from the negligent party. Subject to certain limitations, the injured party may recover compensation for medical bills, lost wages and general pain and suffering. Damages for pain and suffering may include physical and mental pain and suffering, inconvenience, emotional stress and impairment of the quality of life. The injured party is also entitled to receive monetary compensation for any physical impairment or disfigurement caused by the at-fault party's negligence.
